This privacy policy (“Privacy Policy”) explains and discloses how we, MIPS Tech LLC (“MIPS”, “we”, “us”, “our”), collect, use, and store Personal Data in connection with your use of our website, www.mips.com (“Site”) or access to or use of any of our services (“Services”).
When we refer to “Personal Data” in this Privacy Policy, we mean information about an identified or identifiable natural person. By visiting our Site, providing your contact information to receive information from us, registering a user account, or using our Services, you consent to our collection and use of your Personal Data in accordance with this Privacy Policy. If you do not agree to the terms of this Privacy Policy, please do not use the Site or Services.
We may update this Privacy Policy from time to time in order to keep you apprised of our data collection and use practices. Such changes will come into effect immediately upon the posting of the new Privacy Policy. We therefore encourage you to return and review this Privacy Policy from time to time. I. What Information we Collect and How we Use it
We collect and receive Personal Data from you when you submit or send us information about yourself and when you visit our Site, and we use this Personal Data as follows:
- Inquiries. If you contact us to make certain requests or to ask questions, whether by email or through a contact form we make available on the Site (“Contact Form”), we will use this information to respond to your requests or questions. When you submit information through the Contact Form, we may require you to provide us with certain Personal Data such as your name, email address, country, company name, job title, phone number and information about your request. We use the Personal Data you provide in order to respond to your request or inquiry.
- Newsletter or Marketing Sign Up. In the event you sign up to receive promotions, newsletters or other commercial or marketing communications from us or otherwise request to receive such communications, we will use the Personal Data you provide (such as your email address) to send you such communications. We may also notify you about new features, additional offerings, better ways to use the Site or Services, events and special opportunities or any other information we think you will find valuable, and may provide such notices through email, or through our marketing campaigns on any other sites or platforms.
- How we use Personal Data: When you visit or use our Site, we use your Personal Data to:
- Provide you with newsletters or other commercial or marketing communications from us, to respond to your inquiries and requests including via email, and
- Contact you upon any relevant request you may have.
We also collect Personal Data when an individual employee or other authorized user from a current or potential customer, vendor or business partner (“company user”) registers an account in connection with the provision of Services, or when a company provides us with names and contact information of users who should have access to the Services. We use company user’s Personal Data as follows:
- User Accounts: When we create an account for a company user to access our Services, including when the user requests customer support, we may generate a unique username and password, or an API key associated with the account. Generally, we will collect Personal Data from the company user who accesses and uses the account or our Site, or the company user who provides his or her Personal Data when requesting the creation of a user profile on behalf of a company. Such information may include the company user’s name, phone number (office or cell), office address, or home address (for remote employees or contractors). We may also collect the company user’s IP address, connection information and timestamps. We will only collect this information once the company enters into an agreement with us, at which time we will create an account on behalf of the company user.
- How we Use Personal Data: When a company user uses an account in connection with the provision of Services, we use the user’s Personal Data to:
- Provide the company with the Services and with support related to the Services,
- Respond to inquiries and requests including via email,
- Train our employees,
- Improve our products and the Services, and
- Contact the company or its company user upon any relevant request the company or its company user may have.
II. How we Protect, Store, and Share your Personal Data
How we Protect and Store your Data:
- Data Protection. If you are a company or company user who holds an account with us, your account will be protected through password controls to access certain parts of the Site and Services. You will be able to view assets based on the features you have subscribed to.
- Data Retention and Storage.
- Marketing Communications. When you sign up for marketing communications or otherwise inquire about our Site or Services, we will retain your Personal Data until you request to unsubscribe from or stop receiving these communications, at which point we will delete such information within a period of ninety (90) days following your request to unsubscribe. Please be aware that without this Personal Data, we will not be able to send you such communications. You may contact us at any time to request that we stop sending you marketing communications by writing to privacy@mips.com, or opt-out of such communications by using the “unsubscribe” link at the bottom of e-mails we send.
- Retention and Storage. Unless otherwise required due to the nature of your request or the relationship between us, we retain your Personal Data for as long as necessary to respond to or resolve your request or inquiry, or for as long as necessary to comply with our legal obligations, resolve disputes, and enforce our policies. Under applicable regulations, we will keep records containing client Personal Data, account opening documents, communications and anything else as required by applicable laws and regulations. We may rectify, replenish or remove incomplete or inaccurate information, at any time and at our own discretion. If you have an account with us, we store your Personal Data in the United States, regardless of where you are located.
- Data Sharing. We do not rent, sell, or share users’ information with third parties except as described in this Privacy Policy.
How (and with whom) we Share your Personal Data:
- Provision of Services. In addition to the different uses listed above, we may transfer or disclose Personal Data to our subsidiaries, affiliated companies and subcontractors for the purpose of providing or improving the Site or Services.
- Marketing and Analytics. In addition to the purposes listed in this Privacy Policy, we may share Personal Data with our trusted third party providers, who may be located in different jurisdictions across the world, for any of the following purposes:
- Advertising;
- Direct marketing;
- Performing research, technical diagnostics or analytics;
- Data storage and processing.
- Legal Disclosures. We may also disclose Personal Data if we have good faith to believe that disclosure of such information is helpful or reasonably necessary to:
- Comply with any applicable law, regulation, legal process or governmental request;
- Enforce our policies, including investigations of potential violations thereof;
- Investigate, detect, prevent, or take action regarding illegal activities or other wrongdoing, suspected fraud or security issues;
- Establish or exercise our rights to defend against legal claims; or
- Prevent harm to the rights, property or safety of us, our Site, our users, yourself or any third party.
- Disputes. In case of any dispute with or concerning you, we may disclose Personal Data relating to you with our legal counsel, professional advisors and service providers, the relevant court or other tribunal and other third parties as needed in order to resolve the dispute, defend ourselves against any claims, or enforce our rights.
- Mergers and Acquisitions. In the event that we, or a part of our business, are sold to a third party, or if we are merged with another entity, or in the event of bankruptcy or a similar event, we will transfer information about the relevant portions of our business as well as relevant customers and users, to the purchaser or the entity with which we are merged.
- External Links. While our Services may contain links to other websites or services (such as X, LinkedIn, YouTube etc.), we are not responsible for their privacy practices. We encourage you to pay attention when you leave our Site or Services for the website or application of such third parties, and to read the privacy policies of every website and service you visit. This Privacy Policy applies only to MIPS’ Site and Services.
III. Rights of EU Individuals under the GDPR
Users have the right, at any time, to know whether their Personal Data has been stored and can consult with us via privacy@mips.com to learn about their contents and origin, to verify their accuracy or to ask for them to be supplemented, cancelled, updated or corrected, or for their transformation into anonymous format or to block any data held in violation of the law, as well as to oppose their treatment for any and all legitimate reasons. Requests should be sent to us at the contact information set out above.
If you are a resident of the European Union, please note that the following rights specifically apply regarding your personal information under the Regulation (EU) 2016/679, known as the General Data Protection Regulation (the “GDPR”): (1) Receive confirmation as to whether or not personal information concerning you is being processed, and access your stored personal information, together with supplementary information; (2) Receive a copy of personal information you directly volunteer to us in a structured, commonly used and machine-readable format; (3) Request rectification of your personal information that is in our control; (4) Request erasure of your personal information; (5) Object to the processing of personal information by us; (6) Request to restrict processing of your personal information by us; (7) Lodge a complaint with a supervisory authority.
However, please note that these rights are not absolute, and may be subject to our own legitimate interests and regulatory requirements.
This Site does not support “Do Not Track” requests.
To determine whether any of the third-party services it uses honor the “Do Not Track” requests, please read their privacy policies.
We may be permitted by law (including the GDPR and local national laws) to refuse or limit the extent to which we comply with your request. We may also require additional information in order to comply with your request, including information needed to locate the information requested or to verify your identity or the legality of your request. To the extent permitted by applicable law, we may charge an appropriate fee to comply with your request.
IV. Transfers of Personal Data to Other Countries Outside the EU or EEA
- Cross Border Transfers. We transfer European users’ Personal Data to the United States, where we and our marketing services company are located, and where our third party web hosting provider stores our data. Please note that some data recipients may be located outside the EEA. In such cases we will transfer your data only to such countries as approved by the European Commission as providing adequate level of data protection, or enter into legal agreements ensuring an adequate level of data protection.
- Legal Bases for Cross Border Transfers. We transfer European users’ Personal Data to the United States under the following conditions:
- Contractual Obligation. Where transfers are necessary to satisfy our obligation to you under our Terms of Use, including to provide you with or to optimize and enhance our Services and customer support services;
- Consent. Where you have consented to the transfer of your Personal Data to a third country. Where transfers to a third country are based on your consent, you may withdraw your consent at any time. Please understand, however, that our services may not be available if we are unable to transfer Personal Data to third countries.
When we transfer Personal Data to third countries, we endeavor to ensure adequate safeguards are implemented, for example through the use of standard contractual clauses or Privacy Shield certification. If you are an individual protected by the GDPR, you may contact us at privacy@mips.com to obtain additional information regarding the basis for the transfer of Personal Data relating to you to countries outside the European Economic Area. Please note that information or copies of documents we may provide to you in connection with such requests may be limited or redacted in order to protect the rights of third parties or to comply with contractual obligations we may have (such as obligations of confidentiality).
V. Your California Privacy Rights: Rights under Californian Law (CCPA)
If you are a California resident you have the right under the California Consumer Privacy Act, as amended by the California Consumer Privacy Rights Act (the “CCPA”) in connection with our use of Personal Data relating to you, as described below. To exercise such rights, please contact us by email at privacy@mips.com. Please note that certain exceptions may apply.
- Right to Know. You may request to know about the Personal Data that we collect about you and how that information is used or shared.
- Right to Delete. Subject to certain exceptions, you have the right to request that we and any of our service providers delete your Personal Data.
- Right to Correct. If you find that any of the we have collected about you is inaccurate, you have the right to correct such information.
- Right to Opt Out: You have the right to opt out of sale or sharing of your Personal Data as related to cross-contextual behavioral advertising. We do not use cross contextual behavioral advertising.
- Right to Non-Discrimination for Exercising your Consumer Privacy Rights. You have the right not to be discriminated against for exercising any of your consumer privacy rights, such as not being denied any goods or services or charged different prices or rates.
VI. Cookies and Tracking
- Cookies. Some of our systems utilize logging mechanisms for performance and support purposes. To learn more, please visit our Cookies Policy.
- California “Do Not Track” Notice. We do not track individuals’ online activities over time and across third party Web sites or online services, nor do we allow third parties to collect Personal Data about you when use the Site.
VII. Personal Data of Children
The Site is not intended for, and we do not knowingly collect Personal Data from persons under the age of eighteen (18). If you believe that a person under the age of eighteen (18) has provided us with Personal Data, or if we have received the Personal Data of such person, please contact us at privacy@mips.com.
VIII. Unsubscribing to Marketing Communications
You may request that we stop sending you marketing communications by clicking the unsubscribe link located at the bottom of any email you receive from us. However, we may still send you communications in connection with your account, requests or reservations you make, to resolve disputes or as otherwise permitted by applicable law.
IX. Anonymous Information
We may use information we collect or receive which cannot be connected to any particular person or which is anonymized or aggregated such that it can no longer be connected to or used to identify any particular person as Personal Data, even if it was originally linked to or stored with Personal Data. Such information cannot be used to identify you or any other person. We use anonymous information internally for a variety of purposes, including improving the Site and Services, and may share it with third parties or even publish it for any reason.
